McDonald's in litigation with Ukrainian company over Mc'Corn, McCorn trademarks – media

U.S.-registered McDonald's Corporation is in litigation with Ukrainian-based Ascania Trading Holding and demands that the court bar the Ukrainian company from using the Mc'Corn and McCorn trademarks.

This is stipulated in a ruling taken by Kyiv's Economic Court on November 29, as reported by the news outlet LIGA.net.

In particular, Delaware-based McDonald's International Property Company lodged a lawsuit with the court against Ukraine's Economic Development and Trade Ministry and Kyiv-based Ascania Trading LLC, demanding that the use of the said brands be prohibited.

It is noted that Valentyn Ponomarenko and Oleh Zhuravsky are the founders of the Ukrainian company, according the YouControl online system.

Mc'Corn is a private brand of Ascania Trading, the company's website said. Products under TM Mc'Corn are produced in cooperation with Danish-based Popz Holding LLC, the largest European producer of popcorn for cooking in microwave ovens.

The American fast-food giant demands that Ascania Trading be banned from the use and transfer of ownership of trademarks for goods and services under Ukrainian certificates Nos. 130111 and 130112 of October 11, 2010, to other persons, or disclaim the said certificates.

The litigation has been held for a third month in a row. But the preparatory hearing on the case is being constantly postponed. So, the court process is delayed.

Ukrainian-based office of McDonald's refused to specify the reason and details of the dispute, saying that the information is confidential. It is assumed that the U.S.-based corporation could be confused by the use of the first part of the brand's name – Mc.
