Ukraine's KyivBKK company will challenge in the Court of Cassation of the Supreme Court of Ukraine the decisions by Kyiv's Pivnichniy Economic Court of Appeals and Kyiv's Economic Court, which confirmed the correctness of the Antimonopoly Committee of Ukraine (AMCU) about its violation of competitive legislation by imitation of Roshen Confectionery Corporation's packaging design.

The relevant Supreme Court's ruling of May 27 has been published in the Unified State Register of Judicial Decisions.
According to the court's ruling, KyivBKK LLC has filed a cassation appeal with the Economic Court of Cassation at the Supreme Court against the decision of March 2019 by Kyiv's Pivnichniy Economic Court of Appeals and that of November 2, 2018 by Kyiv's Economic Court, which confirmed the AMCU's correctness on the violation by KyivBKK of competition legislation in the cake production. The packaging of cakes is so similar to that of Roshen Confectionery Corporation that may mislead the consumers.
It is noted the consideration of the cassation appeal at an open court hearing is scheduled for June 25.
As UNIAN reported earlier, in the summer of 2018, the AMCU fined KyivBKK, which is part of the Kyivhlib holding, by almost UAH 330,000 ($12,281) for using packaging, whose design is similar to that of Roshen.
