Ukraine's Supreme Court confirms employment contracts may indicate salary in foreign currency

The Supreme Court of Ukraine has confirmed it is lawful to indicate the size of employees' salaries in foreign currency in employment contracts, adding that their payment should be handled in the hryvnia, Ukraine's national currency, only.

The relevant court ruling was published in the Unified State Register of Judicial Decisions, an UNIAN correspondent reported on July 9.

In particular, the court rejected a cassation appeal by a company that lost a lawsuit filed by its employee challenging the employer's non-pegging of the salary to the equivalent in foreign currency mentioned in the employment contract.

As determined in the court's ruling, Ukraine's Civil Code stipulates that the monetary obligation (salary) must be paid in the hryvnia, while one of the Code's articles assumes that the parties may define the monetary equivalent in foreign currency in the employment contact.

"The circumstances established in the case indicate that the defendant's original contract (which is recognized by the defendant) provides for the use of the euro forex rate on the date of payment when determining the salary to be paid in the hryvnia," the court said.

Thus, the Supreme Court upheld the 2017 decision of Kyiv's Shevchenkivsky district court and left it unchanged.

As UNIAN reported earlier, the average nominal salary of a full-time employee grew by 17.4% in May 2019 year-over-year, to UAH 10,239, or US$398.
