Ukrainian president expects Rada to pass concession bill in autumn 2019

The document will enable the government to work safely with the private sector.

Ukrainian President Volodymyr Zelensky expects the Verkhovna Rada, Ukraine's parliament, will pass a bill on concession as a whole in the autumn of 2019.

"In autumn, we'll pass a [draft] law on concession, which will allow the government to work safely with the private sector and private companies," Zelensky said at the Ukrainian-Turkish business forum during his official visit to Turkey on August 8.

"We will be very happy to see Turkish companies as truly reliable partners in our projects. Come in with your capital, experience, and technologies," the president said.

As UNIAN reported earlier, in April 2018, the Verkhovna Rada passed bill No. 8125 "On Concessions" in the first reading, which provides for the possibility of applying concession terms in any economic sphere and introducing a transparent procedure for selecting concessionaires.

The bill foresees a clear distinction between the regulation of concession and other forms of public-private partnership, a single procedure for initiating and deciding on the implementation of public-private partnership.

The document also stipulates the introduction of a transparent procedure for selecting a concessionaire, the possibility of attracting advisers and independent experts to prepare public-private partnership projects in a concession form, as well as additional guarantees for concessionaires and creditors. In particular, a concession agreement provides for the right to replace the concessionaire, simplification of the procedures for allocating land for public-private partnership projects in a concession form.

In addition, the draft law provides the possibility of transferring the resolution of disputes arising within the implementation of concession agreements to international commercial or investment arbitrations, the possibility of initiating a concession by a potential concessionaire, and a clear mechanism for monitoring the fulfilment of such agreements.
