Russia to prohibit collection of debts of Crimean population by Ukrainian banks

Russia’s State Duma plans to consider on May 15 a bill to impose a moratorium on banking and other related activities by legal entities that a resident in Ukraine in the Russian-occupied Ukrainian territory of Crimea, local newspaper Novosti Kryma has reported.

According to the information published on the Web site of the Russian parliament, the State Duma Committee on Financial Markets has approved the document and suggested that it be put to the vote.

According to the text of the bill, it “envisages the imposition of a moratorium on the banking (financial) and related activities, including collection activity, of legal entities that are residents of Ukraine and that do not have a license of the Bank of Russia, that were registered in Crimea until its accession to the Russian Federation, as well as the activity of natural and legal persons acting in their interests. The moratorium is also introduced with regard to conclusion and state registration of any civil transactions of these persons with legal entities residents of the Russian Federation.”

In addition, it is planned to extend the moratorium on execution by the territorial bodies of the Federal Bailiff Service of the Russian Federation of judgments issued by the Ukrainian courts before March 18, 2014 in favor of the Ukrainian banks and other financial institutions working in the annexed Crimea before the above mentioned date. This will allow the suspension of the collection of debts of the Crimean population to Ukrainian banks.

According to the document, for the termination of the moratorium for individual banks, they must appeal via the courts. The basis for such an appeal is the obtaining by a Ukrainian bank or other financial institution of a license from the Bank of Russia and the fulfillment of all its obligations to the Crimean clients – both individuals and legal entities.
