Ukraine mulling high specialized court on intellectual property, economic competition

The country's annual losses from competitive violations amount to 20% of GDP.

Сhair of the subcommittee on the development of competition and equal conditions for businesses of the Committee on Economic Development Liudmila Buimister has proposed that a single high specialized court on intellectual property and economic competition be created in Ukraine.

Buimister says the court will consider all disputes in the field of competition and state assistance to businesses (except for appeals on public procurement procedures) both in the first and in the appeal instances, Ukrainian Parliament's press service said on November 28.

The official added that the not-properly-secured principle of neutrality in competition between business entities of state and private ownership, the inefficient system for resolving competitive disputes in courts, and the imperfect appeals system in public procurement, according to the Anti-Monopoly Committee of Ukraine (AMCU), lead to annual losses at 20% of GDP from competitive violations.

The Committee on Economic Development also held the public discussion on the competition and antitrust reform to improve the system of compensation for damages through court.

As UNIAN reported earlier, the Verkhovna Rada, Ukraine's parliament, decided to hold on December 16 parliamentary hearings on building an effective intellectual property protection system.

By November 30, the Cabinet of Ministers must prepare and submit to the Verkhovna Rada informational and analytical materials for the parliamentary hearings and relevant proposals, as well as determine a rapporteur.
