London Court of Appeal to announce final decision in "Yanukovych debt" case in mid-Sept

Kyiv considers the loan as the Kremlin's "bribe" paid to the former Ukrainian authorities for rejecting Ukraine's European aspirations.

The London Court of Appeal on September 14, 2018, will announce the final decision on Russia's lawsuit against Ukraine on the latter's eurobonds worth $3 billion, bought back by the Russian Federation in December 2013 under an agreement between Russian President Vladimir Putin and the then Ukrainian President Viktor Yanukovych.

"Take notice that on Friday, September 14, 2018, in Court 75, at 10:30, judgment will be given in [case] A4/2017/1755 The Law Debenture Trust Corporation P.L.C-v-Ukraine, represented by the Minister of Finance of Ukraine acting upon the instructions of the Cabinet of Ministers of Ukraine," reads a statement on the court's website.

As was earlier reported, the High Court of Justice in January 2016 began to consider Russia's claim against Ukraine on the latter's eurobonds worth $3 billion. Kyiv considers the loan as the Kremlin's "bribe" paid to the former Ukrainian authorities for rejecting Ukraine's European aspirations. The Russian side insists on the repayment of the loan.

In March 2016, the court approved an expedited consideration of the Russian lawsuit, but Ukraine appealed against this decision. In late July, the court satisfied the motion of Ukraine to fully suspend execution of the court decision until the end of the appeal's consideration.

In January 2018, the Court of Appeal postponed the decision for a later date.

The High Court deals at first instance with all high value and high importance cases, and also has a supervisory jurisdiction over all subordinate courts and tribunals, with a few statutory exceptions. Appeal from the High Court in civil matters normally lies to the Court of Appeal, and thence in cases of importance to the Supreme Court.
