UK court rules to "freeze" $145 mln in dividends from Nord Stream when paid to Gazprom – Naftogaz

The UK Commercial Court of the High Court of Justice within the framework of the Naftogaz of Ukraine lawsuit ordered Russia's Gazprom to pay $145 million to the court account as a guarantee of the court's claims if dividends from the Nord Stream are received.

The court handed down the relevant ruling on June 11, 2019, taking into account the extension of the time limits for consideration of the appeal against the decision of the Stockholm arbitration in Sweden and the probable additional interest on the debt that Gazprom will have to pay to Naftogaz, according to the Naftogaz press service.

In addition, the court obliged Gazprom, when Nord Stream shareholders decide to pay dividends, to get Naftogaz's consent or the court's consent to receive such funds.

The press service recalled the UK's Commercial Court in March imposed additional obligations on Gazprom in part of non-concealment and non-withdrawal of assets from British and Dutch jurisdictions. Besides, the court ordered that Gazprom to provide cash security for $200 million to the court account or escrow account of one of the London banks as a guarantee of the court's claims.

According to the decision of the UK's Commercial Court, enforcement of the Stockholm arbitration award in the Naftogaz vs Gazprom transit case in the territory of England and Wales will be possible after the decision has been handed down by the Svea Court of Appeal.

As UNIAN reported earlier, Gazprom late in February 2018 lost a lawsuit against Naftogaz in the Stockholm arbitration on a transit contract, according to which the Russian company must pay the Ukrainian side $4.6 billion. At the same time, taking into account the decision of the arbitration on the gas supply contract, final amount of settlements between the companies amounts to $2.6 billion in favor of Naftogaz.

Against the background of the defeat, Gazprom announced threir intention to terminate in court the contract with Ukraine for the supply and transit of gas.

On March 20, Gazprom officially notified Naftogaz that it refuses to execute the arbitration decision.

In late May, Naftogaz began the process of forced collection from Gazprom of a $2.6 billion debt in foreign courts.

Trials for the arrest of Gazprom's assets are underway in the UK, Switzerland, and the Netherlands. Among the assets of interest to the Ukrainian side are the shares of companies-operators of the Nord Stream 1 and Nord Stream 2 gas pipelines.
