Poroshenko enacts law on electronic trust services

Ukrainian President Petro Poroshenko has signed the law of Ukraine on trust services for electronic transactions, according to the presidential press service.

The document is aimed at reforming the national regulatory framework in the field of electronic signatures by implementing European Union legislation, developing a single space of confidentiality based on the system of electronic trust services, the report said.

"The law also determines the conditions for the recognition of electronic trust services in Ukraine provided by foreign suppliers, which will ensure the active development of cross-border cooperation and integration of our state into the global electronic information space," the press service said in a statement.

The document defines the legal and organizational basis for providing electronic trust services, including cross-border ones, the rights and obligations of legal entities in the said field, the procedure for state supervision (control) over compliance with the requirements of legislation in the field of electronic trust services, as well as legal and organizational basis for the implementation of electronic identification.

In particular, such mechanisms as electronic identification, electronic signatures, electronic seals, electronic time stamp, electronic delivery services, interoperability, etc. are introduced.

In addition, the law facilitates the cross-border use of online services, creates conditions for secure electronic identification and authentication, as well as mutual recognition of key enablers across borders, such as electronic identification, electronic signatures, electronic documents and services. It also defines basic principles for state regulations on electronic trust services and electronic identification.

The document also introduces an administrative service for the inclusion of legal entities and individuals, the entrepreneurs, who plan to provide electronic trust services, into a trusted list, and the procedure for its compiling. It also stipulates the procedure for an independent assessment of the compliance of the electronic trust services with the national and international standards, and the possibility of using these standards by the said individuals.

As UNIAN reported earlier, the Verkhovna Rada passed bill No. 2155-VIII on trust services for electronic transactions on October 5. It will come into force one year after its publication, except for Article 10, which shall come into force from the day of its publication.
