President’s Chief of Staff Victor Baloha stresses that all draft decrees that were adopted at the government’s session on September 3, are illegitimate, because Prime Minister Yulia Tymoshenko was absent at the session.

This is said in Baloha’s letter to Yulia Tymoshenko.

The President’s Chief of Staff points out that the Law on Cabinet of Ministers of Ukraine sets out that a governmental session is plenipotentiary only when more than half of government members are present (part three Article 48).

As for the government’s session of September 3, only 13 out of 25 government members were present, and Pm Tymoshenko was absent.

“Thus, we believe that all draft decrees that were adopted by government members at this session are illegitimate, because the majority of Cabinet of Ministers members, including the Prime Minister, did not support them”, the Baloha’s letter reads.
