Member of Parliament Svyatoslav Piskun (the Party of Regions faction) will not submit any application for his reinstating on the post of Prosecutor General of Ukraine.

S.Piskun said this in an interview with UNIAN, commenting on the today’s ruling of the District Appeal Administrative Court of Ukraine, which, in fact, returned him on the post.

S.Piskun stressed that the ruling of court cancelled “the illegal decree on my dismissal, which automatically means that the decree on my appointment [as the Prosecutor General] is valid”.

According to S.Piskun, he had no doubt about the court ruling, because the President’s decree [on his dismissal] violated the constitutional provision, in line with which the Verkhovna Rada of Ukraine must give its consent to dismissal of a Prosecutor General. He stressed that lawyers from the Presidential Secretariat “overcomplicated things”.

According to S.Piskun, there is a court ruling, but for him to be reinstated on the post, it is necessary to dismiss Oleksander Medvedko, who is a legitimate prosecutor at present.

S.Piskun pointed out he will not submit any applications to return on the post “because I do not think to return so far”, he said. “I’m a Member of Parliament, the presidential election is upcoming. So I’m not going to return so far”, he specified.

As UNIAN reported earlier, on April 24, the district administrative court of Kyiv declared illegal the decree of President of Ukraine Victor Yushchenko of May 24, 2007,  #469/2007 “On Declaring Invalid President’s Decree of April 26, 2007, #357”. The decree of April 26, 2007, reinstated Svyatoslav Piskun on the post of the Prosecutor General of Ukraine.

S.Piskun’s spokesman Dmytro Ponamarchuk has disclosed this to UNIAN.

As UNIAN reported earlier, on April 26, 2007, President of Ukraine Victor Yushchenko reinstated S.Piskun on post of the Prosecutor General of Ukraine, to implement the ruling of the Shevchenkivskiy district court of Kyiv.

At the same time, on May 24, 2007, Victor Yushchenko signed decree #469/2007 “On Declaring Invalid President’s Decree of April 26, 2007, #357”.

S.Piskun appealed against this decree in court.
