The SBU, police, Prosecutor General’s Office, Ministry of Justice, Finance Ministry and the State Border Service approved a joint directive to organize the conduct of clandestine investigations and using their results in filing criminal cases, according to KW.

Meanwhile, the Justice Ministry told Komentari: that the directive took force simultaneously with the new Criminal Procedures Code of Ukraine. According to the document, secret investigations – i.e. investigative actions in which the methods and the occurrence of such actions are not subject to disclosure unless stipulated by the Criminal Procedure Code.

The following types of clandestine investigative operations are defined by the code: audio and video monitoring of individuals, examination and seizure of correspondence, deleting data from electronic information systems without the knowledge of its owner, examination of publicly inaccessible places, audio and video monitoring of such places, clandestine receipt of samples necessary to conduct a comparative analysis and monitoring of items or places that are publicly accessible.

The ministry stressed that for conducting of clandestine investigative operations a court of law must be informed of the inability to obtain information about a crime or the individual that committed the crime using other methods.
