President of Ukraine Victor Yushchenko stopped the action of the order of the Cabinet of Ministers on relieving Valentyna Semenyuk from the post of chairwoman of the State Property Fund.
It is said in the order of the President from February 7 (№ 106/2008) “On stopping action of orders of the Cabinet of Ministers from February 6, 2008, № 201-Р, № 203-Р, № 204-Р, № 208-Р".
As it is noted in the order, the Cabinet of Ministers on February 6 by its order “relieved from the posts the chairmen of the State Property Fund of Ukraine and also because of the revelation of facts concerning violation of the legislation of Ukraine by the officials of the State Property Fund of Ukraine set the service investigation and relieved V. Semenyuk from the post of the chairman of the SPFU for the period of this investigation”.
At the same time, the President points, that taking into account that according to the Law “On privatization of the state property” and Permanent provision about SPFU the State Property Fund of Ukraine is defined as the state agency, which fulfills the state policy in the sphere of privatization of the state property and the mentioned orders of the Cabinet of Ministers do not correspond to Constitution of Ukraine, according to which the Cabinet of Ministers has the right to decide the staff issues concerning the leaders of the center agencies of the executive power (point 92 articles 116).
Taking into account all the things mention above, the head of the state, in accordance with point 15 of the first part of article 106 of Constitution of Ukraine, stopped the action of the order of the Cabinet of Ministers from February 6, 2008 № 201 “On relieving Victor Petrov from the post of first deputy chairman of the State Property Fund of Ukraine”;an order of the Cabinet of Ministers from February 6, 2008 № 203 “On relieving Anatoliy Hrytsenko from the post of deputy chairman of the State Property Fund of Ukraine”;
an order of the Cabinet of Ministers from February 6, 2008 № 204 “On relieving Oleksandr Potimkov from the post of deputy chairman of the State Property Fund of Ukraine”;
an order of the Cabinet of Ministers from February 6, 2008 № 208 “On carrying out service investigation”.
This order comes into force from the day of its publicizing.
As UNIAN reported earlier, on February 6 the Cabinet of Ministers relieved V. Semenyuk from the post of the chairwoman of the SPFU and appointed Andriy Portnov to fulfill these duties.
The Cabinet of Minister also appointed new deputies chairman of the State Property Fund.
