Yulia Tymoshenko’s lawyer Mykola Siryi has said that the judge in the ex-premier’s case accepted but did not consider their request to resume the proceedings and reopen the judicial inquiry, according to the Official web site of Yulia Tymoshenko.

“Judge Kireyev did not respond to our request,” Mykola Siryi said at a press conference today in Kyiv.

Yulia Tymoshenko`s lawyer pointed to the numerous procedural violations by the presiding judge in the ex-premier’s trial. “Judge Kireyev didn’t consider our request regarding the unlawfulness of Yulia Tymoshenko’s arrest. This request should have been considered – positively or negatively – but the judge should have considered it in the trial and only then closed the judicial inquiry,” he added.

According to him, the judge also did not announce in the courtroom a number of documents that were added to the case file during the last session on September 12. “This is the second major error and the defense lawyers challenged all these procedural mistakes,” he said.

He also noted that the Pechersk District Court didn’t give the defense any justification regarding it actions. “The Pechersk District Court hasn’t explained anything for a long time. If you look at their reasons for refusing to release Tymoshenko or change the measure of restraint, and there are more than 20 decision, there is no justification for any decision. The only motivation was that “the court didn’t see any changes and so will reject, will deny the request," he said.

“Mr. Kireyev should start the hearing on September 27 by reading aloud the documents that he received through the court office. I don’t know whether he will do this or not. He may not. He may simply suggest that the prosecution begin its closing arguments,” Mykola Siryi added.
